THE INCENTIVES PROGRAM - TIP

On July 3, 2025, ​​​​Governor Tony Evers​​​ signed Senate Bill 45 into law, thereby creating the Film Production Services Credit program. Details are as follows:

• Establishes the following tax credits:
  • A 30% transferable tax credit of the first $250,000 of salary or wages paid to each resident employee for services rendered in Wisconsin, excluding the salary or wages paid to the two highest-paid employees, if the budgeted production expenditures are $1 million or more;
  • A 30% refundable tax credit of nonpayroll expenditures, as defined;
  • A transferable tax credit in an amount equal to the sales/use taxes that the production company paid in the taxable year to the extent those taxes are not used in claiming a credit under the nonpayroll expenditure;
• Allows $5 million in credits to be allocated each fiscal year (7/1 – 6/30);
• Limits the total amount of tax credit for any single applicant to $1 million per fiscal year;
• Includes scripted, unscripted, reality, or competition productions in the definition of an accredited production;
• Requirements:
  • Submit written confirmation that a certified public accountant located in this state has been retained to conduct periodic audits to ensure compliance;
  • If the applicant does not have its commercial domicile, as defined, in the state, indicate that in the application;
  • Include the amount of production expenditures it anticipates spending in the state and the amount of expenditures, if any, it anticipates spending in another state on the same production;
  • Exceed $100,000 in aggregated salaries and wages for a production that is 30 minutes or longer, or $50,000 for a production that is less than 30 minutes for the period ending 12 months after the month in which principal photography begins; and,
  • Include an acknowledgment to the state of Wisconsin and the state film office, as designed by the state film office, including a logo designed by the state film office, in the credits.
