ENACTED LEGISLATION

Signed by the Governor

New York (A 9505) and (S 7505)

On April 3, 2020, Governor Cuomo signed Assembly Bill 9505 and Senate Bill 7505 which amend the Empire State Television Writers’ and Directors’ Fees and Salaries credit as follows:

 

  • Disallows any salaries or fees related to a non-credited writer from qualifying for the Empire State Film Production tax credit, previously qualified up to $75,000 per series of episodes.

The Act shall take effect immediately.

Puerto Rico - Act 40

Puerto Rico – Act 40 was passed on April 16, 2020 which amends the Economic Incentives Act for the Film Industry of Puerto Rico as follows:

 

  • Establishes an annual funding cap of $38 million, previously there was no cap.

 

The Act shall take effect immediately.

Virginia (H 1318) and (S 923)

On April 9, 2020, Governor Northam signed House Bill 1318 and Senate Bill 923 which amend the Virginia motion picture production tax credit program as follows:

 

  • Extends the sunset date to December 31, 2026, previously December 31, 2021.

Virginia (H 30)

House Bill 30 proposes to appropriate $4 million to the Governor’s Motion Picture Opportunity Fund for each of the following fiscal years: 2021 and 2022 (7/1–6/30). This fund may be used at the discretion of the Governor to attract film industry production.
